What should a disclosure refuse to state?

01Challenge

You are handed an energy claim: 120 J of compute measured at the wall, a region of 0.94 with no barrier named, and an effect of 0.03 from sixteen seeds. Before you write the rules: how many of its four fields can that setup actually support?

02Model

The European AI Act creates an energy documentation obligation in August 2027 with no methodology attached, and somebody will supply the shape that document takes for a body. The load-bearing half of it is the refusals. A field that cannot be filled from the measurement is not a gap to be estimated, it is a finding: it tells the reader exactly which claim is unavailable and what would have to change in the setup to make it available.

PASS WHEN You wrote a disclosure that refuses on three grounds and passes on the fourth, checking each separately.

If your run fails, check:

The first claim fails three of the four. A mains meter cannot attribute compute; a region with no barrier named is a success rate; and sixteen seeds cannot resolve an effect of 0.03 against a per-episode spread of 0.25.
It PASSES the fourth, and that is worth noticing. A twelve percent architectural difference does clear the five percent a part with an eighty percent idle floor needs at one percent meter resolution. Each condition is checked separately, and a claim that is weak on three grounds can still be sound on the fourth.
Each refusal names a change to the MEASUREMENT rather than to the wording. 'Raise n to about 278' is actionable; 'results may vary' is not. That is the difference between a disclosure and a claim.
The second claim passes all four, and what makes it pass was decided before the run: a dedicated rail, a named barrier, 512 seeds, and a part whose idle floor is low enough that the difference clears the meter.
